This Privacy Policy describes how New York City Regional Center, LLC (“NYCRC”) processes the personal information that we collect, including the purposes for which we use it, the parties with whom we may share it, and your choices with respect to such information. This Privacy Policy applies to our collection and use of personal information (i) regarding investors in NYCRC offerings and (ii) collected through any means where a link or reference to this Privacy Policy is provided. To the extent permitted by applicable law, your use of our services, including your involvement in NYCRC offerings, constitutes your acknowledgment and/or consent to the practices described in this Privacy Policy.

1. The information that we collect:

We may collect personal information directly from you that includes:

• Identification data, such as your first and last name, date and place of birth, nationality, immigration status, passport information, government-issued ID numbers, marital status and family member details.
• Financial data, such as tax information, bank account details, and source of funds details. 
• Contact data, such as your email address, phone number and mailing address.
• Other data not specifically listed here, which we will use as described in this Privacy Policy or as otherwise disclosed at the time of collection.

Third-party sources. We may receive personal information from third-party sources such as the following, and we may combine this information with personal information we receive from you directly:

• Third-party services, such as immigration counsel in connection with petition filings.

• Investment project parties. We may share your personal information with the managing member or manager in connection with your investment.

Where required by applicable law or legal process, or in connection with the EB-5 program, we may share your personal information with law enforcement, governmental entities, regulators and others, including if we believe in good faith that such action is necessary to comply with the law, prevent unlawful activity, defend our rights, or maintain security.
• Other third parties with your consent. We may share your personal information with any other third party where you have provided consent to such disclosure.

4. Third Party Links and Interactions

Our website may contain links to other sites operated by organizations not affiliated with NYCRC. We do not review or endorse, and are not responsible for, the privacy policies and/or practices on other sites. By accessing other third-party websites through our website, you are consenting to the terms of use and privacy policies of those websites. We do not accept any responsibility or liability for their policies whatsoever as we have no control over them. 5. Data Retention

We retain personal information as long as it is reasonably necessary to provide our services, including to administer NYCRC offerings, and for other purposes, including to comply with the law, prevent fraud, resolve disputes, troubleshoot problems, assist with any investigation, or enforce our agreements. To determine the appropriate retention period for personal information, we may consider factors such as the applicable legal requirements, the amount, nature, and sensitivity of the personal information, the potential risk of harm from unauthorized use or disclosure of your personal information, the purposes for which we process your personal information and whether we can achieve those purposes through other means. When we no longer require the personal information we have collected about you, we may either delete it, anonymize it, or isolate it from further processing.

6. Children

We do not knowingly collect or maintain information directly from persons under 13 years of age (“children”), and no part of our services is directed to children. If you are under 13 years of age, then please do not use or access our services at any time or in any manner. If we learn that information has been collected through our services from children and without verifiable parental consent, then we will take the appropriate steps to delete this information. If you are a parent or guardian and discover that your child has provided us with personal information without your consent, please contact us using the contact information below to request that we delete the information from our systems.

7. Visitors from Outside the United States

NYCRC operates in the United States, and any personal information collected pursuant to this Privacy Policy may be accessed from and/or stored by NYCRC, as applicable, or those acting on our behalf, in the United States. If you use our services from outside the United States, you acknowledge that your personal information may be transferred to or accessed from the United States, and consent to such transfer or access.

8. Do Not Track
